Motions in limine by the prosecution in a criminal case?
Q. I understand what a "motion in limine" is. My question is, why should the prosecution in a criminal case be allowed to use them? Isn't the whole purpose of our criminal justice system that the "deck" is supposed to be "stacked" against the state in order to protect the defendant's rights?

A. A motion in limine is a neutral procedural vehicle. It doesn't favor either side or give one side an unfair advantage. It just allows a judge to keep the jury from hearing evidence that isn't admissible under the applicable rules of evidence. Consider this. Suppose the prosecution's main witness to a bank robbery is woman. Should the defense be allowed to put in evidence of how many sex partners she has had? Or that she has children out of wedlock from different fathers? Or that her parents were Hitler youth? Obviously not -- this is prejudicial evidence with no probative value that has no relevance whatsoever to the events or to the witness' credibility. Surely the prosecution should be able to petition the judge for an order… [cont.]

can deferred prosecution mean assisting the da with prosecuting other cases as the program needed to complete?
Q. I am a little concerned with people who are receiving this favorable ruling in a county that doesn't really any programs such as drug court,domestic violence,to defer a defendant into.Can "any" program that the prosecution feels will be in the interest of justice and the community involve busting other people for the police?

A. Deferred prosecution means that this time the DA will not bring evidence against you and the DA will not press charge, which is usually used in exchange of intelligence or co-operation in other cases. As soon as the people do what they should do, there is nothing to worry about them. In fact, they are more scare than you because when the DA finds out they violate the agreement, they bring everything altogether.
