The presumption of innocence – being considered innocent until proven guilty – is a legal right that the accused in criminal trials has in many modern countries. The burden of proof is thus on the prosecution, which has to collect and present enough compelling evidence to convince the trier of fact, who are restrained and ordered by law to consider only actual evidence and testimony that is legally admissible, and in most cases lawfully obtained, that the accused is guilty beyond a reasonable doubt. In case of remaining doubts, the accused is to be acquitted. This presumption is seen to stem from the Latin legal principle that ei incumbit probatio qui dicit, non qui negat (the burden of proof rests on who asserts, not on who denies).

Do you believe the legal "presumption of innocence" should be changed to: Innocent UNLESS proven guilty?
Q. Throughout the legal world people are considered innocent UNTIL proven guilty...hmm. UNTIL means up to the point that a condition occurs...hmm. Would that condition go against the presumption of innocence in the first place???

A. It protects you from unreasonable searches and seizures. Seizure are interpreted by the court to include arrests and use of force issues. The 4th insures that citizens are not arrested or searched for invalid reasons. Innocent until proven guilty is legal concept that even though you may be arrested for a crime you will not face any sort of punishment (i.e. fines, prison, etc.) until you have been convicted by a court of law. People sometimes confuse this with the mere act of being arrested instead of punishment.

Who thinks that Greg Maddux has moved ahead of Roger Clemens as the best pitcher of the modern era?
Q. Due to the relative events pertaining to Roger Clemens, I now move up Greg Maddux from no. 2 to no. 1. However, I believe in the "presumption of innocence" and will keep Roger in my top 5 pitchers of the past 25 years. Randy Johnson, Tom Glavine, and Curt Schilling probably round out my top 5.

A. without a doubt. My reasons? Maddux won games than any other pitcher in the '90's, first pitcher to win 4 consecutive CY Young awards (92-95) during the stretch going 75-29 with a 1.98 era, has 15+ games 17 consecutive seasons, and 17 gold gloves to boot.
